5. Delivery

6. Your right to cancel

Before dispatch, you can cancel a pre-order at any time for a full refund (section 2). After delivery, you have the legal right to cancel within 14 days without giving a reason, as set out in these model instructions under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us (Birkeby (BIRKEBY LTD), 128 City Road, London, United Kingdom, EC1V 2NX, tomas@birkeby.co.uk) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than:

  1. 14 days after the day we receive back from you any goods supplied, or
  2. (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
  3. if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

To return a product, email us first and we will confirm where to send it. Please pack it carefully. You can look at and handle the product as you would in a shop. If it has been used or washed, we may reduce your refund to reflect the loss in value.

These rights are in addition to your right to cancel. If your order arrives damaged, faulty or not as described, email us with your order details and a photo. We pay the cost of returning it, and we refund the full price, including delivery, or replace it if you prefer and we can.

We do not offer a guarantee beyond your legal rights.

Please email tomas@birkeby.co.uk with your order details and what went wrong. We aim to reply within two working days and to resolve complaints within 14 days. If we cannot resolve your complaint, we will tell you about an alternative dispute resolution provider and whether we will use it. See also contact and complaints.

9. Our responsibility to you

If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of it. We are not responsible for loss or damage that is not foreseeable. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit, and nothing in them affects your legal rights.

10. Your personal data

We use your details to take, deliver and support your order. Our privacy notice explains how.
